Terms of sale

1. General provisions

1.1. The terms of sale apply to the purchase of goods and services in the emotionalegghead.com online store between the buyer (hereinafter referred to as the Consumer) and IGCG OÜ (hereinafter referred to as the Online Store) and jointly the Parties.
1.2. In addition to the conditions set out on this page, the relationship between the Consumer and the Seller is governed by the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS) and other important laws in force in the Republic of Estonia.
1.3. The online store has the right to make changes to the terms of sale. These conditions of sale are valid from 21.03.2023.

2. Subject of a contract

2.1. The online store undertakes to provide the Consumer with a subscription service to a service that provides information on a daily basis.

3. Price and payment

3.1. The price for the subscription service is indicated on the website of the online store at the time of placing the order. 3.2. Payment for the subscription service is made by the Consumer using the electronic payment systems indicated on the website of the online store.

4. Rights and obligations of the parties

4.2. The online store undertakes to provide the Consumer with a service subscription service in accordance with the terms of this agreement.

4.3. The consumer undertakes to pay the specified cost for the service subscription to the service and follow the terms of this agreement.

4.4. The online store is not responsible for the impossibility of the Consumer to receive a subscription to the service for reasons beyond the control of the online store.

5. How to place an order

5.1. The order for the service subscription to the service is issued by the Consumer on the website of the online store.

5.2 The consumer must provide the necessary data for placing an order, as well as correctly fill in the information for payment.

6. Right to refuse the service and refund

6.1. The consumer has the right to unsubscribe from the service at any time.

6.2. The online store returns the funds for the unused subscription period within 10 working days from the date of receipt of the written application of the Consumer.

7. Confidentiality

7.1. The online store undertakes to ensure the confidentiality of information received from the Consumer.

7.2. The consumer undertakes not to transfer his credentials to third parties.

8. Responsibilities of the Parties

8.1. The parties are responsible for non-fulfillment or improper fulfillment of their obligations under this agreement.

8.2. In case of violation of its obligations by the online store, the responsibility is borne by the online store in accordance with applicable law.

8.3. In case of violation by the Consumer of his obligations, the Consumer is liable in accordance with applicable law.

9. Duration of the contract

9.1. The contract is considered concluded from the moment the Consumer pays for the subscription to the service. 9.2. The contract is valid for the period specified when placing an order on the website of the online store.

10. Changing the terms of the contract

10.1. The online store has the right to make changes to these terms of the contract.

10.2. Changes come into force from the moment they are published on the website of the online store.

11. Dispute Resolution

11.1. Disputes arising between the Parties under this agreement will be resolved through negotiations.

11.2. If it is impossible to resolve the dispute through negotiations, the dispute shall be resolved in court in accordance with applicable law.

12. Additional conditions

12.1. This agreement is a public offer.

12.2. This agreement is governed by and construed in accordance with the laws of the Republic of Estonia.

12.3. The Parties recognize an electronic document created under this Agreement as equivalent to a written document.

13. Delivery and provision of services

13.1. The order is processed automatically, and the ordered goods and invoice arrive at your email address within one hour under normal conditions. In the case of the payment method by bank transfer, the order is executed after the confirmation of the order by the online store.
In order to deliver without delay, you must be careful to provide true and valid data when entering shipping data at checkout.

14. Right of return and claim procedure

14.1. The consumer has the right to contact the online store to resolve claims.

14.2. The consumer has the right to a refund if the product or service does not correspond to the content described in the online store.

14.3. If the Consumer is unable to participate in the event for which he has purchased a ticket, you can choose a replacement product in the online store as compensation or receive a refund of up to 75% of the participation fee upon notification. at least 7 days before the event.

14.4. If the Consumer is unable to participate in the consultation meeting, one can choose to replace the product in the online store as compensation or receive a refund of up to 75% of the participation fee with at least 3 days' notice.

15. Force majeure

15.1. The online store is not responsible for the damage caused to the Consumer or the delay in the delivery of goods or services if the damage or delay in the delivery of the goods is caused by circumstances that the online store could not influence or foresee.

16. Processing of personal data

16.1. The online store uses the personal data entered by the Consumer only to process the order and send the goods to the buyer or provide services.

16.2. The online store sends newsletters and offers to the consumer to the buyer's e-mail address only if the buyer has expressed his desire to do so by entering the e-mail address on the website and has indicated his desire to receive notifications by mail.

17.3. The consumer may at any time opt out of offers and newsletters sent by e-mail by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

17. Right of the consumer to apply to the Consumer Complaints Commission

17.1. If the Online Store refused to resolve the Consumer's complaint or the Consumer does not agree with the solution proposed by the Online Store and believes that his rights have been violated or his interests have been infringed, the Consumer may file a complaint with the Consumer Complaints Service. commission through the Consumer Protection Department or in court. The consumer can file a complaint himself or through a representative.
